To the fullest extent permitted by law, THEMIRACO, its directors, officers, employees, agents, affiliates, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to:

  • Your access to, use of, or inability to use this site;
  • Any transaction or product purchased through this site;
  • Any unauthorized access to or alteration of your data;
  • Any statements, conduct, or omissions of any third party on this site.

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot be limited or excluded under applicable law.

Actual delivery times may vary due to factors beyond THEMIRACO's control, including but not limited to delays caused by postal or courier services, customs clearance, adverse weather, or other unforeseen circumstances.

 

  • THEMIRACO shall not be held responsible or liable for any delay or failure in delivery arising from such factors, and no compensation or claim shall be payable in respect of any delay. Title and risk in the products shall pass to you upon dispatch from our warehouse.

6. Typographical and Pricing Errors

In the event that a product or service is listed at an incorrect price or with incorrect information due to a typographical error, system error, or an error in pricing or product information received from our suppliers, THEMIRACO reserves the right to refuse, cancel, or amend any orders placed for such product or service, regardless of whether the order has been confirmed or payment has been processed.

If payment has already been processed for the purchase and your order is cancelled, THEMIRACO will issue a full refund to the original payment method for the amount charged. THEMIRACO shall not be obligated to honour any order at an incorrect price or based on incorrect product information.

7. Software

All intellectual property rights in any software, code, scripts, applications, or other copyrighted materials (collectively, “Software”) and any related documentation made available through this site remain the property of Themiraco, its licensors, or its technology providers (including, but not limited to, Shopify).

Without our prior written consent — and without prejudice to any applicable statutory rights under the Copyright, Designs and Patents Act 1988 or the Copyright (Computer Programs) Regulations 1992 (as amended) — you must not, and must not permit any other person to:

  • Disassemble, reverse-engineer, decompile, or otherwise attempt to derive the source code of the Software;
  • Copy, modify, adapt, or create derivative works based on the Software; or
  • Circumvent, disable, or otherwise interfere with security-related features of the Software.

Subject to the terms of this Agreement, you are granted a limited, non-exclusive, non-transferable licence to use the Software solely for the purposes of browsing, shopping, and otherwise engaging with the services provided through THEMIRACO's website.

You must not transfer, assign, or sub-license your right to use the Software, nor attempt to do so.

8. Matters Beyond Our Reasonable Control

THEMIRACO shall not be held responsible or liable for any failure to perform, or delay in performing, any of our obligations under this Agreement where such failure or delay results from events, circumstances, or causes beyond our reasonable control. These may include, but are not limited to: Acts of God, fire, lightning, extreme weather conditions, explosion, war, terrorism, civil disorder, flood, industrial disputes (whether or not involving our employees), epidemics or pandemics, failure of power supply, acts or omissions of internet service providers, disruptions to transportation networks, or acts of local or central government or other competent authorities.

In such circumstances, our obligations will be deemed suspended for the period that the event or circumstances continue, and we shall have an extension of time to perform these obligations for the duration of that period.

9. Gift Vouchers and Voucher Codes

  • E-gift cards purchased online are non-refundable and cannot be exchanged for cash.
  • Discount vouchers may be applied toward the purchase of goods with a total value exceeding the voucher amount, with the remaining balance payable by credit or debit card.
  • Discount vouchers can be redeemed only on purchases made through themiraco.com and are subject to any specific terms and conditions communicated at the time of issue.
  • Refunds on purchases made using discount vouchers are subject to these terms and conditions. Vouchers are non-transferable and have no cash value.
  • Unless otherwise specified, only one discount voucher code may be used per customer and only one voucher can be redeemed per transaction.
  • Discount vouchers cannot be combined with other promotional offers, gift vouchers, or loyalty points unless explicitly stated.
  • Themiraco reserves the right to suspend or cancel any purchase or voucher redemption if it reasonably suspects misuse, fraud, or breach of these terms.
  • Voucher codes cannot be applied retroactively to completed transactions.
  • THEMIRACO reserves the right to amend or withdraw voucher terms and conditions at any time without prior notice. Such changes do not affect your statutory rights.
  • THEMIRACO is not liable for any failure to honour or process vouchers due to circumstances beyond its control, including but not limited to acts of God, technical failures, or governmental actions.
  • Voucher codes apply only to the full recommended retail price (RRP) of products unless otherwise stated.

These terms shall be governed by and construed in accordance with the laws of England and Wales.

  • Our website may contain links to third-party websites that we believe may be of interest to our customers. Please be aware that once you click on these links and leave the THEMIRACO site, we have no control over the content, policies, or practices of those external websites.

11. Pricing

All product prices displayed on the THEMIRACO website are inclusive of applicable taxes, including GST or VAT where required by law.

At the checkout stage, any applicable tax, GST, or VAT will be clearly itemized and displayed in your order summary before payment is completed.

Shipping costs shown during checkout also include any relevant taxes, GST, or VAT.
